  • Granny Flat Exemptions in West Auckland: What You Need to Know Before You Build

Thinking about building a granny flat in West Auckland? It’s a smart way to add extra living space, create rental income, or keep family close. But before you start, make sure you understand the latest exemption rules. Especially around plumbing & wastewater.

The Ministry of Business, Innovation and Employment (MBIE) now allows some small, detached dwellings to be built without full building consent; as long as they meet strict exemption criteria. This can save time and money, but it doesn’t remove the need for proper planning, professional input, or council involvement.

🏠 Building Scope

To qualify for the exemption, your granny flat must be:

  • Detached and standalone – not attached to another house or garage
  • Single-storey only
  • Maximum floor area: 70 m² or less
  • Maximum height: 4 metres
  • Floor level: no more than 1 metre above ground
  • No mezzanines or decks higher than 1.5 metres
  • Lightweight materials – walls ≤ 220 kg/m², roof ≤ 20 kg/m²

These rules are designed to keep granny flats simple, structurally low risk, and easy to build on most standard residential sections.


📐 Site & Location Requirements

Your granny flat build also needs to fit your site correctly:

  • At least 2 metres from all legal boundaries
  • Minimum 2 metres from any other dwelling
  • Cannot cross a title boundary
  • Must comply with local zoning, flood-hazard, and infrastructure rules

💡 Tip: Always check your local Auckland Council planning maps before you start, especially in flood-prone areas or properties with shared driveways.


🚿 Plumbing & Drainage Rules (including Septic Systems)

This is where many projects; particularly rural and lifestyle properties; can come unstuck. Even under the exemption, all granny flat plumbing and drainage must meet the NZ Building Code and be carried out by a licensed plumber or drainlayer.

  • Properties connected to council services must connect to council wastewater, stormwater and water services where available
  • If your property is not connected to council sewer, your existing septic or on-site wastewater system must be:

    ✅ Fit for purpose

    ✅ Capable of handling the additional loading created by the granny flat

    This means the system must be assessed for:

    •Additional bedrooms and occupants

    •Increased daily wastewater volume

    •Soakage capacity and soil conditions

    If the existing system cannot cope, an upgrade or replacement will be required, and this may trigger a Resource Consent, even if the building itself qualifies for a consent exemption.

    All on-site wastewater systems must comply with:

    • G13 (Foul Water)

    • G12 (Water Supplies)

    • E1 (Surface Water)

      ✅ On-site wastewater treatment must meet AS/NZS 1547:2012

  • Licensed Building Practitioner (LBP) – for the structure
  • Plumbers and Drainlayers that are fully licensed – for water and sanitary systems

🏛 Council Involvement

Even when full consent isn’t needed, you still need to work with council.

  • You must notify council before starting and after completing the work
  • Consent is only excluded if every exemption condition is met

An exemption is not a free pass.

You may still need Resource Consent depending on your zoning, overlays, or site conditions.

Remember that building cannot start until your exemption has been formally accepted by council.

And remember; you’ll still need licensed professionals for design, construction, plumbing, electrical work, and (if required) engineering sign-off.
